In these Terms and Conditions, ‘we’, ‘us’, ‘our’ or ‘The Promoter’ refers to the Colliers Real Estate Managed Property, Wall Street Mall, that is running this promotion.
All decisions are final, and no correspondence will be entered into. The promotion is conducted in good faith, but we do reserve the right to modify, suspend, cancel or terminate this promotion should circumstances arise that compromise the fairness or conflict with the Terms and Conditions of the promotion.
Eligibility
1. To be eligible you must:
a. Complete the “Win a pamper package this Valentines Day” form.
b. Join the Wall Street Mall email database.
2. The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted or ineligible entries.
3. Entrant’s consent to the collection and retention of personal contact details in accordance with our Privacy Policy found on our website https://wallstreetmall.nz/. Details are held and used for future promotional purposes. Under the Privacy Act 2020, entrants have the right to access or correct their details or unsubscribe from this list at any time by sending an email to info@wallstreetmall.nz.
4. Entry into competition is deemed acceptance of these Terms and Conditions.
5. We reserve the right to disallow deny receipt, request verification of eligibility and/or proof of purchase; refusing award of prize where false or misleading details have been supplied, entry behaviour is dishonest or fraudulent or compromise is made on the spirit of this promotion.
6. The promotion is open to Otago, New Zealand residents, 18 years and over only (all as at the date of entry). Employees, directors or managers of the Promoter and any suppliers, providers or agencies directly involved with this promotion and the immediate families of such parties, are not eligible to enter.
7. Competition is valid for participating retailers only. Bank and limited service transactions such as layby payments, insurance, offices and casual leasing tenant purchases are not included.
Promotion
a) The Prize
a. This promotion offers the chance to win the single prize of with an estimated retail value of $500.00. It consists of a pamper package including gifts from Lush, Luxurious Spa & Nails, Marbecks Foodstore, The Rub, and Vish Beauty Bar. This is the ‘Prize’.
b. The prize is not transferrable or refundable and cannot be exchanged or redeemed for cash.
c. The winner accepts the prize at their own risk and is responsible for care and use the prize as it was intended, design and instructed. We are not liable for any loss, theft or damage of the prize.
d. In the event that the prize/s or any part of the prize becomes unavailable for any reason beyond our control, the provision of an alternative prize, at our discretion, will be supplied.
e. The winner fully indemnifies the Promoter, and all associated with the Prize and this competition, against all claims, damages, liabilities, costs and expenses (legal fees inclusive) that may occur from participation and/or use of the Prize.
b) Entry Forms
Incomplete, inaccurate, erroneous, ineligible, indecipherable or illegible entries and receipts will be deemed invalid.
All entry forms and details entered onto the form become the property of Wall Street Mall and may be used for promotional and marketing purposes or passed onto a third party involved in the promotion for their marketing purposes. Our Privacy Policy applies and can be found by clicking here.
c) Promotional Period
The ‘promotion period’ runs from 11.59am, 7 February 2024 to 5.00pm, 14 February 2024 and will be drawn from all valid entries submitted by 5.00pm, 14 February 2024. Entries received outside of the promotion period will not be eligible. We take no responsibility for receipt or collection of late entries.
d) Promotion Draw
The promotion draw will take place at the management office no later than the first working day after the promotion entry period closes. It will be drawn in the presence of two members of the management team. We reserve the right to redraw should the drawn entry not comply with eligibility requirements.
If the winner is unable to collect, accept or use the prize for any reason, we will draw a new winner with no compensation to the original winner.
e) Winner/Winner Notification
The winner of the promotion will be notified by phone or email on the day of the draw. The winner must claim the prize within seven days of notification. We reserve the right to validify identity and eligibility and can request identification and receipts as proof of purchase. These must be provided upon collection of the prize.
We reserve the right to extend this timeframe or redraw at our discretion from remaining correct entries.
If the prize is unclaimed, we are not obliged to take any further action in relation to the promotion.
The winner must comply with all instructions and terms and conditions associated with the acceptance and use of the prize and must not do anything to bring the promoter into disrepute.
f) Announcement of Winner - Publicity
The winner agrees to comply with publicity as the Prize Winner and agrees to the use of their name, likeness, image and/or voice in any media, without charge and with reasonable availability for this purpose.
g) Limitation of Liability
To the extent permitted by law, the Promoter excludes all liability for any costs, expenses, losses and damages suffered or incurred by the entrant, including any liability for personal injury or death or loss of business opportunity or liability due to negligence of the Promoter or its personnel, whether direct, indirect, special or consequential, arising in connection with these Terms and Conditions or the conduct of the promotion (including, without limitation, in connection with, participation in the promotion by the entrant, the Prize, the unavailability of any Prize, any tax liability incurred by the entrant; or any variation in the value of the Prize.

7 Gift Cards
7.1 Gift Cards may be issued, used and accepted, by Wall Street Mall including, where available, at Wall Street Mall and/or through the Website. The Gift Card remains the property of Wall Street Mall. It cannot be copied or reproduced in any circumstances. Gift Cards are not legal tender, account cards, credit or debit cards. However, they are to be treated as cash. Keep in a safe place as lost or stolen cards will not be replaced.
7.2 All Gift Cards are exclusive to Wall Street Malland may be used in store at any participating retailers (‘Participating Retailers’) for their goods and services. Wall Street Mall will provide a list of Participating Retailers following your request. Gift Cards cannot be used for purchasing products online.
7.3 Gift Cards can be loaded with any amount between $5.00 and $00.00. Each card can only be loaded at the time of purchase. Additional credit cannot be added to the Gift Card and you cannot consolidate multiple cards. Balances cannot be refunded, redeemed for cash nor will change be given. Gift Cards are valid for 12months from the date of purchase, at which time they will expire, and all remaining unused balance will be forfeited.
7.4 Gift Cards are deemed void and not redeemable if they are defaced, altered or tampered with in any way and will not be replaced or reissued. Participating Retailers reserve the right not to accept payment or part payment of any item, where they reasonably suspect the Gift Card may have been stolen or obtained in any other illegal way.
7.5 Wall Street Mall is not liable for the availability, quality or fitness for purpose of any goods or services purchased with the Gift Card. Any disputes over goods or services purchased using a Gift Card must be resolved directly with the Participating Retailer from where they were purchased. Any disputes or errors in a transaction involving your Gift Card must be addressed to the Participating Retailer where the error was made to rectify the error. Reimbursed funds from returned goods cannot be returned to your Gift Card.
7.6 To the maximum extent permitted by law:
7.6.1 Wall Street Mall will not be liable to you for any costs, expenses, losses and damages you suffer whether direct, that may arise in connection with any goods or services purchased by the redemption of your Gift Card;
7.6.2 Wall Street Mall will not be liable to you for any indirect, special or consequential loss or damage arising under or in connection with these Terms; and
7.6.3 In the event Waal Street Mall is liable to you in relation to a Gift Card, this liability will not exceed the amount loaded onto that a Gift Card at the time of purchase.
7.7 Wall Street Mall may cancel any Gift Card, or the Gift Card programme for any reason, at any time and without notice. Should this occur, a refund or replacement with an alternative Gift Card will be issued with the existing balance to the holder on presentation of their existing Gift Card.
8 Intellectual Property
8.1 Wall Street Mall either owns or otherwise has the right to use all copyright and other intellectual property rights in this Website and reserves all rights, save as provided in this disclaimer, and all such rights are reserved. You may electronically reproduce and store the contents of this Website solely for the purposes of viewing this Website, or saving Website content, for your own personal use.
8.2 Unless we have given our written consent, in relation to this Website you must not:

11 Assignment
11.1 In the event of a change in ownership or management of Wall Street Mall, or of all or a portion of our Website, you acknowledge your personal information may be transferred to the new owner or management company, without requiring your further consent.
12 Compliance with Laws
12.1 You agree to comply with all applicable laws, statutes and regulations relevant in any way to your use of this Website or the material or functionality of this Website.
13 Invalidity
